General Conditions of sale
Article 1 - Scope of application
The present conditions of sale concern the products sold on the site www.neomenials.com and are applicable to the exclusion of all others, in particular those which govern sales in store. Persons wishing not to pay shipping costs have the possibility to pick up their order at the head office, against presentation of the order and under condition of payment.

Article 2 - Orders
Orders are placed on the website www. neomenials.com. The contractual information, written in French, will appear on the order confirmation document.
The validation of your order implies full acceptance of these terms of sale.
Neomenials reserves the right to refuse an order from a customer with whom there is a dispute concerning the payment of a previous order.
Under the terms of Article L221-5 of the Consumer Code, the customer has a period of fourteen clear days to exercise his right of withdrawal without having to provide justification or suffer penalties. The customer is then reimbursed (except for the cost of returning the product, which remains at his expense).
Products must be returned in their original, undamaged packaging.
The return costs are at the customer's expense. The refund will be made after recovery of the goods, subject to their good condition, by credit card.
Article 3 - Availability
Neomenials cannot guarantee the availability of the entire catalog presented online. We offer for consultation a database of nearly 1000 references of herbal medicines and Bach flowers. All these products are not available from their producers who supply us directly.
In this case, after checking the availability with our suppliers, you will receive an email indicating the delivery time and, in case of total unavailability, your order will be immediately cancelled and refunded if necessary.
For the products indicated as available on order, the offers present on the site are valid under reserve that the stocks indicated by the suppliers are not erroneous.
Neomenials is committed to refunding any order which could not be served but cannot pay for this reason any compensation.
Article 4 - Prices
Our prices are indicated in euros, all taxes included (excluding preparation and shipping costs which are dependent on the shipping zone and are calculated before confirmation of the order).
Prices may be updated at any time without notice.
Article 5 - Shipping costs
The shipping costs are calculated as accurately as possible according to your delivery address and the total weight of the products in your order. You can have an estimate by creating a basket with the products that interest you.
Article 6 - Payments
Orders are invoiced and payable in Euros.
When you pay by credit card, a debit of the amount of the shipped goods will be made as far as possible each time a package is sent.
In the case of a payment by e-card or virtualis bank card, or in the case of a bank card that expires less than 2 months plus the current month after the date of the order, the price is payable in full and in one payment on the date of the order (the banking system does not allow us in these cases to make split debits satisfactorily).
Any customs duties or local taxes for deliveries outside of Metropolitan France are the responsibility of the recipient, who is then the importer. For shipments outside the European Union and DOM-TOM (French Caribbean), the price will be calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These fees and charges are beyond the control of Neomenials. They are at your charge and are your responsibility, both in terms of declarations and payments to the authorities and agencies of your country.
The delivered and invoiced products remain the property of Neomenials until full payment of the price.
Payment can be made by credit card (Visa, Eurocard, Mastercard), by check, or by national or international transfer.
In the case of cheques or payments by bank transfer, delivery will take place upon receipt of the transfer.
Article 7 - Payment security
Payment by credit card on the vivicorsi-bio.fr website is fully secured and encrypted by our bank. The sensitive information transmitted at the time of payment is subject to SSL encryption.
Article 8 - Delivery
Neomenials, as part of its sales contract, is fully responsible for the delivery and transportation of the products to the address indicated at the time of the order, the inherent costs being accessories to these operations.
The risk of loss or destruction shall be borne by the Buyer upon delivery, even if he is not the owner of the goods delivered. He shall personally bear any insurance charges.

Orders not served within 30 days will be cancelled unless otherwise specified.
Some countries restrict the entry of goods into their territory. It is the buyer's responsibility to ensure the conditions of access of the ordered articles in the country of destination.
Neomenials shall not be held responsible for any destruction or blocking of the package upon entry into the destination country.
Article 9 - Delivery times
Deliveries are made from Monday to Saturday inclusive (except holidays).
Any order that reaches us before noon is processed the same day.
Orders are always shipped as soon as possible. Except for specific periods (Christmas...) the average delay observed is 3 working days from the day the order is placed for products in stock (and indicated as "short lead time" on the catalog). Neomenials undertakes to deliver within 30 days maximum from the day the order is placed for products displayed as in stock. Article 10 - Remainders and return of goods
We do not manage the remainders. You have 14 clear days to exercise your right of withdrawal without having to justify your reasons or pay any penalty, with the exception, if necessary, of the return costs (Cf: Article 121-20 of the Consumer Code). Article 11 - Regulated sales
Regulated sales. The following essential oils are sold to the public only in pharmacies: Absinthe*, Anise*, Mugwort, Fennel*, Hyssop*, Sage, Thuja, Tansy. (*: customs control). The purchase is reserved to: pharmacists, doctors, veterinarians and/or authorized companies.
Article 12 - Legal guarantee of conformity
Neomenials is held responsible for the defects of conformity of the good to the contract under the conditions of article L. 211-4 and following of the code of consumption and for the hidden defects of the sold thing under the conditions envisaged in articles 1641 and following of the civil code.
If you act in legal guarantee of conformity, you :

have a period of two years from the delivery of the property to act;

may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;

You are exempted from proving the existence of the lack of conformity of the goods during the twenty-four months following the delivery of the goods if they are new.
This legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.
You can decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and, in this case, you can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
Article L217-4 of the Consumer Code
The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.
He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at his charge by the contract or has been carried out under his responsibility.
Article L217-5 of the Consumer Code
The good is in conformity with the contract:

Article L217-12 of the Consumer Code
The action resulting from the defect of conformity is prescribed by two years as from the delivery of the good.
Article L217-16 of the Consumer Code
When the buyer asks the seller, during the course of the commercial warranty granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days shall be added to the duration of the warranty that remained to run.
This period starts from the date of the buyer's request for intervention or from the time the goods are made available for repair, if this is later than the request for intervention.
Article 1641 of the civil code
The seller is bound by the warranty for latent defects in the thing sold which render it unfit for the purpose for which it was intended, or which so diminish that use that the buyer would not have acquired it, or would have given only a lesser price, if he had known of them.
Article 1648 of the Civil Code (first paragraph)
The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
Article 13 - Disputes
In case of dispute, French law applies.
In accordance with the provisions of articles L 611-1 and R 612-1 et seq. of the French Consumer Code concerning the amicable settlement of disputes: When the consumer has sent a written complaint to the professional and has not obtained satisfaction or an answer within two months, he may submit his complaint free of charge to the consumer mediator. The mediator must be contacted within a maximum of one year from the initial complaint.
